1. Acceptance of Terms
These Terms of Service (“Terms”) are a binding agreement between you and Lumen Apps Studio (“Lumen,” “we,” “us,” or “our”). They govern your access to and use of Lumen VPN, the websites, applications, software, and any related services (collectively, the “Services”).
By accessing or using the Services, you represent that you have read, understood, and agree to these Terms and our Privacy Policy.
2. Eligibility
You must be at least the age of majority in your jurisdiction to use the Services. If you are under 18 (or the age of majority where you live), you may only use the Services with the consent of a parent or legal guardian who accepts these Terms on your behalf.
3. Accounts & Security
- Accuracy: If you create an account, you must provide accurate and complete information and keep it updated.
- Credentials: Keep your credentials confidential. You are responsible for activity under your account.
- Security: Notify us immediately of any unauthorized access or suspected breach at [email protected].
4. License & Restrictions
Lumen grants you a personal, limited, revocable, non-transferable, non-exclusive license to install and use the client applications solely to access the Services, subject to these Terms.
Restrictions
- No reverse engineering, decompilation, or derivative works except where permitted by law.
- No resale, sublicensing, or unauthorized commercial use.
- No removal of proprietary notices or circumvention of security or usage limits.
5. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation.
- Infringe intellectual property or privacy rights.
- Transmit malware, conduct fraud, or engage in phishing or spam.
- Interfere with network integrity, attempt unauthorized access, or overload our infrastructure.
- Engage in activities that would expose Lumen to legal liability (including prohibited content or unlawful distribution).
We may implement network management (e.g., rate-limiting, abuse prevention) to protect service integrity.
6. Plans, Fees & Taxes
Some or all of the Services may be offered for free or as paid plans. If you subscribe through an app store or our site, fees, billing cycles, renewal terms, and refund policies will be disclosed at purchase.
- Renewals: Subscriptions may auto-renew unless canceled according to the platform’s rules.
- Taxes: Prices may exclude taxes, duties, or fees; you are responsible for applicable taxes.
- Third-Party Stores: Purchases via Apple App Store/Google Play are subject to their terms in addition to ours.
7. Availability, Updates & Changes
We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time, with or without notice. Software may auto-update to improve performance and security.
8. Intellectual Property
The Services, including software, UI, trademarks, and content, are owned by Lumen or our licensors and are protected by applicable laws. Except for the limited license in Section 4, no rights are granted to you by implication or otherwise.
9. Third-Party Services
The Services may interoperate with third-party software, SDKs, or infrastructure (e.g., VPN protocols like WireGuard® or OpenVPN, diagnostics SDKs configured for anonymized analytics). Their use may be subject to third-party terms and privacy policies.
10. Disclaimers
The Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be error-free, secure, or uninterrupted, or that all threats or unauthorized access can be prevented.
11. Limitation of Liability
To the fullest extent permitted by law, Lumen and its affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business interruption, arising out of or related to your use of the Services, even if advised of the possibility of such damages.
Our aggregate liability for all claims relating to the Services shall not exceed the greater of: (a) the amount you paid to Lumen for the Services in the 12 months prior to the event giving rise to liability, or (b) USD 50 (or equivalent).
12. Indemnity
You agree to indemnify, defend, and hold harmless Lumen, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Services.
13. Suspension & Termination
We may suspend or terminate your access to the Services immediately for violations of these Terms, suspected abuse, legal or security risks, or discontinuation of the Services. You may stop using the Services at any time. Sections that by their nature should survive (e.g., IP, Disclaimers, Liability, Indemnity, Governing Law) will survive termination.
14. Export, Sanctions & Acceptable Regions
You must comply with applicable export control and sanctions laws. You represent that you are not located in, under the control of, or a resident of any embargoed country or prohibited end-user list, and you will not use the Services for prohibited purposes.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates. For users contracting with Lumen Apps Studio in Abu Dhabi, the courts of Abu Dhabi shall have exclusive jurisdiction, unless mandatory consumer protection laws of your country provide otherwise.
Before filing a claim, the parties will attempt to resolve disputes informally for 30 days after written notice.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date above and, where appropriate, provide in-app or website notice. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
